Custodial Death of undertrial people and Human Rights Violation in India

Abstract

Custodial deaths, a major human rights violation, are prevalent in India. This research proposal aims to investigate custodial deaths in India, analyzing the issues, stakeholders, legal provisions, and challenges and delves into the causes, Inadequate resources, torture, and overcrowding fuel this issue, disproportionately impacting marginalized communities. With 1,731 deaths in 2021, the study explores factors such as police pressure and prison conditions contributing to this human rights violation. Legal frameworks exist, but implementation gaps persist. Stakeholders include the police, victims, government, media, and NGOs. The research involves interviews, statistical analysis, and reviews of court judgments. Solutions include accountability measures, awareness campaigns, and improved prison conditions to address this pervasive issue.
