EVOLUTION OF LQBTQIA+ RIGHTS IN INDIA

ABSTRACT:
Human rights are basic rights that are designated to every human being since their birth. Every human
being deserves dignity, respect, and equal rights anything that obstructs these common rights is said
to violate human rights. Concerning this, the LGBTQIA+ community has been a target of various
challenges ranging from discrimination, and abuse to social exclusion and torture. Many countries
have finally started giving thought to the rights of this community and providing them with equal rights
and protection. Homosexuality in India was criminalized under section 377 of the Indian Penal
Code,1860 during the colonial era which made gay sex punishable for 10 years, it was said to be
“against the order of nature”. In 2018 Homosexuality was decriminalized in India becoming a ray of
sunshine for the people in this community. However, discrimination against the people of this
community hasn’t changed, thorough implementation and special laws are needed to push the
tolerance of people from different sexualities and gender identity.
